Are mortgage rates high or returning to normal? Here's what to do

 
 


There is no doubt that interest rates are a lot higher than they have been for some time. It can be a shock to the system when it’s time to renew your deal and suddenly you are paying significantly more. However, if we put the current rates into historical context, they still represent good value for money.

Mortgage interest rates
In recent years, interest rates have been exceptionally low. This has caused us to think that the current increases are higher than they really are. According to Moneyfacts, a standard variable rate mortgage in 2020 was 4.90%* and the average five-year fixed mortgage in September 2023 was 5.67%.** The lowest average mortgage interest rate in the past 25 years was in September 2021 at 3.59%, with the highest being 8.87% in September 1998.*** Current forecasts indicate that they will never fall to the ultra-low levels of the past and that they are rebalancing to historically normal levels.

The bank base rate
September 2023 saw a bank base rate of 5.25% which represents a significant decrease from rates of 17% in 1979, 13.88% in 1990 and 7.25% in 1997. Base rates have risen since February 2022 (0.50%.****) and may rise again, but only slightly, and this should not significantly impact mortgage interest rates. The good news is a falling inflation rate of 6.8% in September 2023 will help to lower interest rates.****

More support
Nowadays, there is more you can to than ever to combat rising mortgage rates. Mortgage support such as interest-only payments and longer terms help a lot of people adjust to more normal rates. In the past, there was little or no assistance, which led to a less stable market. More stability makes for a healthier, predictable housing market which allows you to move between homes without sudden changes. This, in turn, means you can get on with making your move today and feel more secure.

Mortgage options
There are also plenty of products and options to choose from such as porting. This means you can buy a new property with your existing mortgage. Hence, if you are paying a more favourable rate on a fixed term, you don’t have to put off moving. When you have to ask permission from the Community of Owners to have work done on your house in Spain

 
 

 
Sometimes your villa or apartment in Spain needs a bit of a spruce up, so you think you’ll redecorate a bit and do a bit of building work while you’re at it. Maybe paint the outside or change the doors. 
 
But be careful, because there are some types of home renovation work that you must ask for permission to carry out from the community of owners first. Before you do anything it is compulsory, as stated in the Horizontal Property Law, to contact your Community Administrator, who will inform you about the steps to be taken.
 
If you live in an apartment building, residential urbanisation or other community, the owners’ management group on big Resorts or the President on small communities is in charge of certain communal tasks, such as approving changes to homes within the bounds of the community. This is because they will be interpreting the Statues with the assistance of the Community Administrator.
 
Essentially, it boils down to anything that alters or affects the common areas of the property, as well as changes to the façade, load-bearing walls and similar, but in all cases you would do well to consult the statutes and regulations laid out in the rules set by the community of owners itself.

Closing in your terrace
For instance, to put in a conservatory you need permission not only from the community of owners but perhaps also from the local municipal council. This is because this type of renovation alters the common elements of the community and the municipal area, changing the appearance of the building’s exterior façade. As such, permits will normally need to be requested, although it will of course depend on what is included in the statutes of the community of owners. If you close off the terrace or balcony space to make a conservatory without asking for permission, you could be in breach of the law and may be liable to be sued for an urban planning violation, having increased the built area of your home. Besides this, remember that it could be a problem once you decide to sell your property if you have not asked for the necessary authorisations and the buyer requires them.
 
Pergolas and awnings
Another change that you will often have to ask permission for from the community of owners and possibly even the town hall is the installation of pergolas, awnings or any other element that may affect the aesthetics of the building’s exterior.
Most communities like to set out a series of rules regarding the design, colour and model of awnings that may be installed in order to give the neighbourhood a uniformity and harmony, so you cannot necessarily just go ahead and put in any old type you want.
 
Air conditioning
Giving permission for the installation of air conditioning systems that go on the outside of the building is not automatic as this still needs to comply with community bylaws. However, any deviations to the community bylaws would need permission, and will need a possibly unanimous vote by the community to approve, unless this was for adaptive living rights under disability protections or other exceptions included in the Horizontal Property Law.
 
Painting your house
Painting the façade of your home is also an alteration of the community’s common elements, so the Horizontal Property Law (LPH) establishes that this change must be submitted to the consensus of the rest of your neighbours. Furthermore, as it is considered a major work, it will also be necessary to present the project to the town council and obtain a building permit.
 
Changing the doors
Changing the main entrance door to your house or villa does not require the permission of the rest of your neighbours, as a general rule. However, if you want to make the doorway bigger or put it in another place, you will need permission. Before making any changes, you should consult the community statutes just in case, since some communities do stipulate agreements about changing the doors.

Taxes you must pay in Spain when gifting a property

What happens after you’ve accepted an offer?

 
Accepting an offer on your home might feel like the final stage of your sale, when in reality, it’s just the beginning. Once you’ve chosen a buyer for your home and agreed on a price, the conveyancing process can commence. It’s important to know exactly what to expect so that you can prepare for the challenges ahead.

Instructing a conveyancer
The first thing you need to do is find a conveyancer, which can be done either before or after you’ve accepted an offer on your home. When selling a property, instructing a conveyancer early will give you a head start and help you avoid potential delays. Before you’ve even secured a buyer, your conveyancer can:
  • Verify identity
  • Source your property deeds
  • Draft up the contract
  • Obtain a copy of the lease (if applicable)
  • Instruct you to complete your conveyancing protocol forms
Having these key things ready well in advance can cut down on the conveyancing process by weeks and ensure that there aren’t any unnecessary roadblocks on your end.

Sold Subject to Contract
Once you have secured your buyer and accepted their offer, your estate agent will draft a Memorandum of Sale. At this point in the process, your listing will be labelled as Sold Subject to Contract (SSTC) which means that the sale of your house will not be legally binding until contracts have been exchanged. Therefore, you are still allowed to receive and accept other offers at this stage.

Pre-exchange
The pre-exchange phase is the longest part of the conveyancing process, as this is where your conveyancer works with the buyer’s conveyancer, estate agent and all other parties involved to advance your case. During this time, all your crucial documents and forms will be sent to the buyer’s party through your conveyancer, including title deeds and the draft contract. They will also address any queries from you or the buying party, which is when negotiations may arise.

Common things to negotiate and agree on may include:
  • Fixtures and fittings (inclusions and sale price)
  • The date of exchange and completion
  • Resolution of issues from the buyer’s survey.

Your agent can negotiate on your behalf, so let them know exactly what you want and are willing to agree on.

Pre-completion
Pre-completion should be a period of calm where the uncertainty is over, and you can start planning for your move and tying up loose ends. Your completion day could be set anywhere between 7-28 days after the exchange of contracts, and this date should be agreed with the buyer. However, there is no minimum or maximum timeframe between exchange and completion, so you may have to negotiate to suit your circumstances.

Completion
Completion takes place on your agreed moving day and is the last step in the process of the sale. Completion day is when ownership is transferred from the seller to the buyer, keys are handed over, and you can officially move out of your old home and into your new one.

An Energy Performance Certificate could add value to your home, and understanding the significance of an EPC rating is crucial.

What is an EPC rating?
The Energy Performance Certificate was first introduced to the government in 2007. It then became a legal requirement in 2008 to have an EPC rating when selling or renting a property.* This was put in place because 13% of emissions that contribute to global warming come directly from homes.** The result encouraged sellers and renters to adopt saving-energy measures, and the EPC ratings helped identify energy-efficient properties on the market. Energy-efficient homes were able to fetch a higher price on the market as they added value to the home.

The EPC gives you a rating from A to G on how energy-efficient your home is. With A being the most efficient and G being the least efficient. This EPC rating has been put in place to increase people’s knowledge and awareness of the effect homes have on global warming and hopefully decrease the overall emissions from properties within the UK.

How is my EPC rating calculated?
Numerous property-related factors go into calculating your EPC rating. To get an EPC rating on your property, you will need to find an energy assessor. An energy assessor will conduct an assessment and study the contributing factors in your home. The factors that contribute to your home's EPC rating are your overall energy costs, your property’s internal layout, the boiler, insulation, windows, your central heating system, and any hot water tanks. It is important to plan for your assessment, for example, if you have loft insulation or have just had double glazing fitted, you need to present the paperwork to the assessor; they cannot just take your word for it.

Murcia has worst water drought in Spain but no water restrictions. Why?

The region of Murcia is a success story when it comes to dealing with water shortages, and could show the rest of Spain - and Europe - how it's done.
 
Last month's rains notwithstanding, it has been a drier than usual year for the south and east of Spain. Drought has fairly ravaged the Mediterranean areas of the country, from Catalonia to Andalucía, and numerous municipalities and millions of people living there have had to live with water restrictions.

But there's one place where things are - miraculously - very different. The Region of Murcia is one of the driest regions in all of Spain, and the reservoirs that feed the water supply are at worryingly low levels, yet it is a long way from introducing any water restrictions for the summer.
 
Why is that?
Mainland Spain is split into 16 different areas for water management, and Murcia almost entirely corresponds to the Segura basin area. In this area, water levels are falling week by week, and right now are at about 20% capacity.

Compare that with 35% at this same point last year, or the average over the last decade of 42%. In Barcelona, a state of emergency due to drought was decreed when their reservoirs were at 16%, so not far off the Murcia level.

Altea in Alicante has already put a ban on filling up swimming pools in several areas of the municipality due to the drought.
However, as expert in water resources and teacher of Geography at the University of Murcia, Encarna Gil, says, Murcia is different for one simple reason.

"We are always in drought," she says. "The southeast of Spain is the most arid part of the mainland, only similar to a part of León and another part of the Ebro depression. But with one difference: we have less rainfall."
 
 As Gil explains, rainfall in Murcia is very irregular, with an average of only 300 millimetres per year and a dry period that can last for up to 10 months of the year:

"We have a Mediterranean climate where it is normal to experience a summer drought, but we have an extreme case. It should rain in autumn, spring and winter, but the peculiarity of our area is that this is not the case."

This should, in theory, cause massive problems for Murcia, a Region that - somewhat conversely it may seem - has one of the largest and most productive fruit and vegetable agriculture industries in the country.

But it is exactly this consistent lack of rainfall that means Murcia is so well placed to deal with drought, and not suffer the consequences.
"Our water use is much higher than what we have naturally, and we have been without water for a long time because there was no water in the reservoirs, how have we always overcome this without restrictions? Because of desalinated water and water treatment plants," explains Gil.

Knowing that water is and has always been an issue for Murcia, the authorities have for a long time invested heavily in desalination plants and wastewater treatment plants to be able to maintain a steady supply of water. In fact, they were even tipped at one point to be in a position to send water by boat to help out Andalucía with their drought situation.

According to data provided by the Spanish Association of Water Supply and Sanitation, Murcia is, in fact, the Spanish territory where most water is regenerated and reused, with more than 90% of the water staying in constant circulation.
 
Murcia is followed by Alicante, a long way behind with 65%. For Spain as a whole, the percentage of water reused is much lower - just 8.1% - and in Europe it is only 5%.

"In Murcia we treat even more water than what is required [by EU law], and to this water we add the water from the Tajo-Segura water transfer and groundwater. Of course, Murcia is a success story because we are reusing almost 100% of our water. We are reusing everything and that reactivates the circular economy of water," underscores Encarna Gil.

The Murcia Sanitation and Purification Entity (ESAMUR), a public body dedicated to water management in the Region, records as many as 100 treatment plants in the territory, generating up to 121 cubic hectometres of water per year, a volume that is four times the annual consumption of the entire population of the city of Murcia.

In terms of desalination plants, Murcia is, after the Canary Islands, the autonomous community in Spain with the highest number of plants. In addition, the second desalination plant with the largest production capacity in Spain is located in the southeast. This is the Águilas Guadalentín plant, with a capacity of up to /0 cubic hectometres per year. These facts contrast, for example, with the situation in Catalonia, which has just three plants and where a drought situation had to be declared.

"Will we in Murcia reach the situation in Catalonia in terms of restrictions? The answer is no," assures Gil. "For rainfall we would be the same as Catalonia, but we have infrastructure that they don't have there."

In addition to using a large proportion of water from wastewater and desalination plants, Murcia's agriculture sector, a highly water-intensive activity, works to a great degree on a digitalised drip irrigation system, one of the most water-saving techniques that exists.
 
 
The Murcia Institute of Agricultural and Environmental Research and Development reports that this technique is used in 90% of the agricultural plantations in the territory, compared to only 16% in the rest of the country.

That's not to say that the drought doesn't affect Murcia. It does, but this part of Spain just began to prepare for it earlier and with more technological resources than other parts of the country, which could learn a lot from Murcia's 'success story.

Gil concludes that the key to the future is to continue saving water, to continue to innovate and to continue investing.

"We also have to do research into different types of crops, we have to look for new varieties that need less water. This is the way forward."

The Owners’ Golf Championship The biggest and best week at La Manga Club!

 
 
With a regular churn of sales and purchasers, it has come to our attention that there are people who aren’t aware of the Owners Week and the golf tournament that accompanies it. Initially inaugurated by P&O back in the early days of LMC, it was designed as a thank you to those who had committed to LMC with a property purchase.
